Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “your”, or “Customer”) and Swix Labs LLC, the company that operates GuestVet (“GuestVet”, “we”, “us”, or “our”) governing your access to and use of the GuestVet website, waitlist, applications, and services (collectively, the “Service”). By accessing or using the Service, clicking “I agree,” or joining our waitlist, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case “you” refers to that entity. If you do not agree to these Terms, you must not access or use the Service.
2. Description of the Service; Not a Consumer Reporting Agency
GuestVet is an AI-assisted research tool that helps short-term rental hosts and property managers make informed decisions about prospective guests. The Service aggregates and analyzes publicly available information — including guest reviews published on third-party platforms — and uses artificial intelligence to surface patterns, sentiment signals, and risk indicators.
GuestVet is not a “consumer reporting agency” as defined by the U.S. Fair Credit Reporting Act (“FCRA”), 15 U.S.C. § 1681 et seq., and the information we provide is not a “consumer report.” You agree that you will not use the Service, or any information obtained through it, in whole or in part:
- As a factor in establishing an individual’s eligibility for credit, insurance, or employment;
- For tenant screening or any decision relating to long-term residential housing tenancy;
- For any other purpose covered by the FCRA or any equivalent state law; or
- In any manner that would cause GuestVet to be deemed a consumer reporting agency.
Short-term rental stays are not residential tenancies. You are solely responsible for ensuring your use of the Service is consistent with this Section and with all applicable law.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and capable of forming a binding contract to use the Service. By using GuestVet, you represent and warrant that you meet these requirements and that you are not barred from using the Service under the laws of any applicable jurisdiction. The Service is intended solely for use by hosts and property managers operating short-term rental properties.
4. Accounts and Security
Certain features require an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@guestvet.com if you suspect any unauthorized use. We may suspend or terminate accounts that we reasonably believe have been compromised or used in violation of these Terms.
5. Acceptable Use
You may use the Service solely to evaluate prospective guests for your own short-term rental listings, and only in a lawful manner. You agree that you will not, and will not permit any third party to:
- Use the Service in any way that violates applicable federal, state, local, or international law or regulation, including fair housing, anti-discrimination, consumer-protection, and data-protection laws;
- Discriminate against any person on the basis of race, color, national origin, religion, sex, gender identity, sexual orientation, familial status, disability, age, source of income, or any other characteristic protected by law;
- Use the Service for stalking, harassment, intimidation, or to threaten or harm any individual;
- Resell, sublicense, rent, lease, or otherwise make the Service or any report output available to third parties, or use it on behalf of anyone other than yourself;
- Use the Service to build or train a competing product or model, or reverse-engineer, decompile, or scrape the Service or its outputs;
- Circumvent, disable, or interfere with security or rate-limiting features, or introduce malware or other harmful code;
- Submit false, misleading, or unlawfully obtained information, or use the Service in violation of any third-party platform’s terms; or
- Use the Service for any purpose other than evaluating prospective guests for your own rental properties.
We may investigate and take any action we deem appropriate for any actual or suspected violation, including suspension or termination and reporting to law-enforcement authorities.
6. Fair Housing and Anti-Discrimination
GuestVet is committed to equal access to housing and lodging. You are solely responsible for ensuring that your use of the Service complies with the Fair Housing Act, the Americans with Disabilities Act, and all applicable federal, state, local, and international fair housing and anti-discrimination laws. GuestVet reports must never be used as a basis for declining, charging more to, or otherwise treating a guest differently on account of any protected characteristic.
Any risk indicators or flags in a GuestVet report relate exclusively to a prospective guest’s publicly documented conduct as a guest — such as alleged property damage, rule violations, or a pattern of disputes — and not to any personal or protected characteristic of the individual.
7. Data Protection Responsibilities of the Customer
When you use the Service to research individuals, you act as an independent data controller (or the equivalent under applicable law) with respect to the personal data you submit and the reports you receive. GuestVet processes that data on the basis described in our Privacy Policy. You represent and warrant that, with respect to each individual you research, you have a lawful basis to do so and will comply with all applicable data-protection laws, including the EU and UK General Data Protection Regulation (“GDPR”) where it applies.
In particular, where GDPR or a comparable law applies to your use, you agree to: (a) limit your queries and use of reports to what is necessary and proportionate to assess a specific, genuine booking; (b) not use reports to make solely automated decisions that produce legal or similarly significant effects on an individual without meaningful human review; (c) handle any personal data you obtain securely and retain it no longer than necessary; and (d) honor data-subject requests and respond to regulators as required by law. You will indemnify GuestVet for claims arising from your failure to meet these obligations, as set out in Section 16.
8. Accuracy, AI Outputs, and Limitations
GuestVet reports are generated from publicly available data and automated, AI-based analysis. We do not guarantee the accuracy, completeness, currency, or reliability of any information in a report. Reports reflect a point-in-time snapshot, may contain errors or omissions, and may not reflect recent changes to an individual’s record.
AI-generated summaries, sentiment signals, and risk scores are probabilistic and may produce false positives or false negatives. They are intended to be one input among several and must be subject to your own independent, human judgment — never the sole basis for a booking decision. To the fullest extent permitted by law, GuestVet disclaims liability for any decision you make based on a report.
9. Fees, Billing, and Trials
Some features of the Service are or will be offered on a paid basis. Where fees apply, you agree to pay all charges at the prices then in effect, plus applicable taxes. Payments are processed by our third-party payment processor, Stripe; by subscribing you authorize Stripe to charge your payment method on our behalf and you agree to Stripe’s terms. We do not collect or store your full payment-card details. Subscriptions renew automatically for the same period unless you cancel before the renewal date through your account settings. Except where required by law, fees are non-refundable and partial periods are not prorated. We may change prices on prospective notice; changes take effect at your next renewal. Any free trial or early-access credits are offered at our discretion and may be modified or withdrawn at any time before launch.
10. Intellectual Property; License
The Service and all associated content, features, software, models, and functionality are and will remain the exclusive property of Swix Labs LLC and its licensors, and are protected by intellectual-property and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. We reserve all rights not expressly granted. Our names, logos, and trade dress may not be used without our prior written consent. You retain ownership of any data you submit, subject to the license in Section 11 and the terms of our Privacy Policy.
11. Feedback and Submitted Data
If you submit data to generate reports, you grant us a worldwide, non-exclusive, royalty-free license to process that data solely to provide and secure the Service and as described in our Privacy Policy. If you provide suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or obligation to you.
12. Third-Party Services and Links
The Service may rely on or link to third-party websites, platforms, and services that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of them is governed by their own terms. The inclusion of any link or integration does not imply our endorsement.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive — including Sections 2, 7, 8, 10, 11, and 14 through 19 — will survive termination.
14. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY REPORT WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SWIX LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION.
16. Indemnification
You agree to defend, indemnify, and hold harmless Swix Labs LLC and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms or applicable law; (b) your use of the Service or any report; (c) your processing of personal data, including any failure to meet your obligations under Section 7; or (d) your violation of any third-party right, including any fair-housing, privacy, or data-protection right.
17. Governing Law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws rules, and, where applicable, by U.S. federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this Section deprives a consumer of the protection of mandatory provisions of the law of their country of habitual residence where such protections cannot be derogated from by agreement.
18. Dispute Resolution; Arbitration; Class Waiver
Except where prohibited by applicable law, you and GuestVet agree to first attempt to resolve any dispute informally by contacting legal@guestvet.com. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, on an individual basis. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights.
TO THE EXTENT PERMITTED BY LAW, YOU AND GUESTVET EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. This Section does not apply where, and to the extent that, applicable law (including for consumers in the EEA or UK) renders mandatory arbitration or class-action waivers unenforceable; in that case, disputes will be heard by the competent courts of your jurisdiction.
19. Changes; General Terms
We may modify these Terms from time to time. If we make material changes, we will post the updated Terms on this page, update the “Last updated” date, and, where required, notify you. Changes take effect when posted (or on a later stated date), and your continued use of the Service after that constitutes acceptance. We may also modify, suspend, or discontinue any part of the Service at any time.
These Terms, together with the Privacy Policy and any order or plan you agree to, constitute the entire agreement between you and GuestVet regarding the Service and supersede any prior agreements. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure). You agree that we may provide notices to you electronically, including by email or by posting on the Service.
